2. Terms of Use

By using the Services in any manner, including but not limited to visiting or browsing the Site, you (the "user" or "you") agree to be bound by this Agreement. This Agreement applies to all users of the Services, including without limitation users who are vendors, customers, merchants, contributors of content, information and other materials or services on the Site. 

These terms and conditions apply to the use of https://vilavitaparc.com/shop website or any of the associated domain names (stated as “VILA VITA Parc” below). By accessing this website and/or placing an order you agree to be bound by the terms and conditions set out here. If you do not agree to be bound by these terms and conditions you may not use or access this website.

VILA VITA (P) Actividades Turisticas e Hoteleiras, Lda. (stated as "VILA VITA (P)" below) recommends that you print out and keep a copy of these terms and conditions for future reference. These terms and conditions apply to all transactions on this website. Please read them carefully. They do not affect your statutory rights.

VILA VITA (P) makes no warranties regarding the accuracy of the information on the website. However, you are always welcome to contact us, if you find incorrect information on the website. VILA VITA (P) is entitled to change the content of the website at any time without preceding notice.  VILA VITA (P) reserves the right to make changes to our sites, policies, and these terms and conditions at any time. If any of these conditions shall be deemed invalid, void, or for any reason unforeseen, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition. Please do not assume that the same terms will apply to future orders.

If the website links to a third party website, VILA VITA (P) makes no warranties for the content of the third party website. These links are made for your convenience only, but it is at your own risk when you visit a third party website.

We make no warranty that VILA VITA Parc website will meet your requirements or will be uninterrupted, timely or error–free, that defects will be corrected, or that the site or the server that makes it available are free of viruses or bugs or represents the full functionality, accuracy, and reliability of the website.

We will not be responsible or liable to you for any loss of content or material uploaded or transmitted through any of our websites.

VILA VITA (P) cannot be liable for any delays or for non-performance due to force majeure. For as long as a force majeure situation persists, VILA VITA (P) is relieved from performance of its obligations.

VILA VITA (P)'s liability for any and all claims is limited to an amount equal to the price of the good purchased by you. VILA VITA (P) assumes product liability vis-a-vis you under applicable law.

4. Brands, trademark and logos

The content of the website such as text, graphics, icons, images, videos and audio files are the property of VILA VITA (P) or their associated companies and partners. Downloading content from the website is only allowed for personal, non-commercial use, provided you keep the copyright intact. You may not copy, republish or distribute content from the website for public or commercial purposes or otherwise use the copyrighted content without permission from VILA VITA (P) or their associated companies and partners, as the case may be.

VILA VITA Parc website and VILA VITA (P) respect the intellectual property of others, and we ask our users to do the same. The content on the Website, including without limitation, the text, graphics, and photos created by and for VILA VITA Parc and VILA VITA (P) partners, interactive features ("Content") and the trademarks, service marks and logos contained therein ("Marks"), are owned by or licensed to VILA VITA (P) and VILA VITA (P) partners, subject to copyright and other intellectual property rights under Portugal and foreign laws and international conventions. Reproduction without consent is prohibited.

VILA VITA (P) and VILA VITA (P)’s partners graphics, logos, designs, page headers, button icons, scripts, and service names are registered trademarks, trademarks or trade dress of VILA VITA Parc in Portugal and/or other countries.  VILA VITA (P) and VILA VITA (P)’s partners’ trademarks and trade dress may not be used, including as part of trademarks and/or as part of domain names or email addresses, in connection with any product or service in any manner that is likely to cause confusion.

Property rights for some of the elements that are visible on VILA VITA Parc website can be of tierce parts and especially of partner brands. They will keep all the relative rights associated to these elements including but not limited to access rights, modifications rights and relative content or creations suppression rights.

6. Privacy policy

All the information you provide to https://vilavitaparc.com or any other associated domain names is strictly private and confidential. According to the data protection act we will treat all such information including name, address and email in the strictest of confidence. Customer information will not be disclosed to or shared with any persons outside of VILA VITA (P) and the brands we are operating. We do not store credit card details nor do we share customer details with any third parties.

When you are using VILA VITA Parc website, some information can be collected: url links from the site you have accessed the website, user internet provider and user IP. VILA VITA (P) is committed not to publish, exchange, transfer, give or sell this personal information on any mean to third parties of any kind.

We use cookies, clear gifs, log files, and flash cookies for several purposes, including to help understand how people interact with our site and services, in order to provide a better experience. 

Although VILA VITA Parc does not currently respond to “do not track” browser headers, you may control online behavioral ads. You also may limit certain tracking by disabling cookies in your web browser. 

7. Customer

The customer declares being a natural person, being at least 18 years old and having the legal ability (or have a parental permission) to purchase goods on the website. When entering their personal information to place an order or in the customer account section (“my account”), the customer must make sure the information provided is complete and correct. 

In case of a mistake in the delivery address information, VILA VITA (P) cannot be liable for being unable to deliver the goods. VILA VITA (P) reserves the rights to cancel any order if the customer IP address is located in a different country from the billing and/or delivery address.

8. Products

Products available are those described on the website https://vilavitaparc.com/shop. VILA VITA (P) is taking special care in presenting and describing the goods in order to provide as many information as possible to the customer. VILA VITA (P) makes no warranties regarding the accuracy of the information on the website. However, you are always welcome to contact us, if you find incorrect information on the website. VILA VITA (P) is entitled to change the content of the website at any time without preceding notice or to exercise your right of withdrawal and VILA VITA (P) will proceed in exchanging or reimbursing the good sold.

If VILA VITA Parc partner brands have insufficient stock to deliver the goods ordered by you, we will notify you as soon as possible and any sum debited by VILA VITA (P) will be re-credited to your account and VILA VITA Parc will notify you by email at the address given by you in your order form. The refund will be made as soon as possible and in any event within 30 days of your order. VILA VITA (P) will not be obliged to offer any additional compensation for disappointment suffered. 

We update our website as quickly as we can to minimize disappointment. The process of updating the website when goods have sold out can take a few hours to update. 

Please note that colours on our website may vary slightly depending how your monitor is calibrated. We do our very best to make sure all our images are true to the actual product you are purchasing but we cannot guarantee a perfect match every time due to almost limitless variations in home monitor set ups.

9. Order

When ordering on VILA VITA Parc website, the customer must respect the process set in place by VILA VITA (P) resulting in several different steps that the customer must follow to submit his order. Before final validation of his order, the customer will be able to check the order details and total amount and correct any possible mistakes before accepting the order. 

A final and binding contract will be concluded between you and VILA VITA (P) when your order is confirmed by VILA VITA Parc. By placing an order you agree to be bound by the terms and conditions set out here. 

VILA VITA (P) can refuse an order placed by a customer having litigation with VILA VITA (P) or dispute in relation with a former order payment. In the event of such order rejection, VILA VITA (P) will inform by email the customer. 

Unless the customer can provide the appropriate personal details enabling VILA VITA (P) to process and ship the order, or correction these elements in case of mistakes in line with these terms and conditions, VILA VITA (P) will be allowed not to process the order. 

VILA VITA Parc will send an order confirmation by email when the order has been confirmed and shipped (with details regarding products, prices, sizes, quantities, shipping country…). The order receipt received immediately after placing the order does not constitute an order confirmation. The customer is accepting the use of email as a valid confirmation by VILA VITA (P) of his order content.

10. Price and taxes

All prices are stated in euros, inclusive of VAT and other taxes, not including shipping costs . The applicable price is the one stated in VILA VITA Parc online shop’s cart in respect of the relevant product on the date of placing of the order. When ordering goods in the VILA VITA Parc online shop an amount may be added in payment of shipping costs, if the product requires it.

Products sold have to be paid on the day the order is made through a PayPal account (via a customer account or by credit card), or through wire/bank transfer. Payment data is neither used nor recorded by VILA VITA (P). Data recorded by PayPal payment provider is valid proof of financial transactions. When paying by wire/bank transfer, you must contact customerservice@vilavitaparc.com with proof of transfer, so VILA VITA Parc can begin the wire transfer confirmation. Only after successful confirmation will VILA VITA Parc deliver or ship you the product.

VILA VITA (P) reserves the right to amend any prices incorrectly stated in the VILA VITA Parc online shop. Furthermore, VILA VITA (P) reserves the right to amend any prices, taxes and/or other costs stated in the VILA VITA Parc online shop at any time, e.g. due to changes in VAT rates or other public fees and charges, increased costs or as a result of the general development in retail prices. 

You shall comply with all applicable domestic and international laws, statutes, ordinances and regulations regarding your use of the Site and any VILA VITA Parc service and, if applicable, your listing, purchase, solicitation of offers to purchase, and sale of items. In addition, you shall be responsible for paying any and all taxes applicable to any purchases or sales of items you make using the Services (excluding any taxes on VILA VITA (P) net income).

11. Delivery

Products ordered on VILA VITA Parc's website are directly processed and shipped by our partner brands and through their selected carrier with recorded delivery parcels (or equivalent). Once the products shipped, a parcel tracking number will be at your disposal into your personal customer account (“My account”). The customer will be informed by email when the tracking number is available in his account.

Delivery is made at the address entered by the customer, stated as the customer’s home address or any other person’s home address at the customer’s best convenience. Delivery cannot be made to hotels or postal boxes. In order to meet our expected delivery period, the customer shall make sure that the personal information provided is completed and correct (including but not limited to delivery address, street number, building number, stairs number, access codes, names and/or intercom numbers…).

Usual time of delivery is informative only and based on an average delivery time observed according to the shipping country and delivery country. VILA VITA (P) cannot be liable for any delays or consequences of delay due to a late delivery of the products as any delay is not on its part. In case of a damaged parcel (already open, missing products…), the customer is committed to notify the carrier and the brand by all means in the three (3) days following the delivery.

12. Right of withdrawal

You have a right to withdraw from the contract entered into without giving any reasons. The cooling-off period is 14 firm days, calculated as from the date on which you received the goods.

If you want to withdraw from the contract, please send an unambiguous statement to VILA VITA Parc [VILA VITA (P), Act. Tur. Hot. Lda - Rua Anneliese Pohl, Alporchinhos - 8400-450 Porches - PORTUGAL]. In your statement please indicate your name, physical address, phone number, email address, order number and which products you wish to return. You must return the goods to VILA VITA Parc without undue delay and no later than 14 days after the date when you have informed us that you want to withdraw from the contract. To retain proof that you have withdrawn from the contract in due time, you should keep the receipt or return tracking number stating that you have handed over the goods to the postal services, etc., for the purpose of dispatch. In case of return you shall bear the direct cost of returning the goods (postage/freight).

You are only liable for any impairment of the value of the goods caused by other handling than what is necessary to determine the nature, quality and function of the goods.

The right to withdraw from the contract does not apply for goods produced according to your specifications or with a clear personal touch.

If you exercise your right to withdraw from the contract, we will refund all payments received from you, excluding delivery and additional costs.

13. Repayment

If you exercise your right to withdraw from the contract, we will refund all payments received from you, excluding delivery and additional costs without unnecessary delay and in any event no later than 30 days after the date when we received your request to withdraw from this contract.

Refunds will be credited to your original method of payment or through an equivalent voucher unless you have explicitly accepted otherwise. In any event you will not be charged with any fees as a result of the repayment.

We may withhold the repayment until we have received the goods or until you have submitted documentation that the goods have been returned, as may be appropriate.

14. Litigation and choice of law

These terms and conditions apply to the use of https://vilavitaparc.com website or any of the associated domain names (stated as “VILA VITA Parc” below). By accessing this website and/or placing an order you agree to be bound by the terms and conditions set out here. If you do not agree to be bound by these terms and conditions you may not use or access this website. These terms and conditions are held sway by Portuguese law.

In the event a dispute arises between you and VILA VITA Parc or a partner brand, VILA VITA (P) encourages you to contact us or the partner brand to resolve the dispute amicably.  

If a buyer and seller are unable to resolve a dispute resulting from a transaction that occurs on VILA VITA (P), this Agreement shall in all respects be interpreted and construed with and by the Portuguese law.
